Indian government rejection of Vedanta bauxite mine a "landmark victory" for Indigenous rights

Amnesty International today described the Indian government's decision
to reject the bauxite mine project in Orissa's Niyamgiri Hills as a
landmark victory for the human rights of Indigenous communities.
India's Ministry of Environment and Forests today rejected the mine
project proposed by a subsidiary of UK-based Vedanta Resources and the
state-owned Orissa Mining Corporation, after finding that the project
already extensively violates forest and environmental laws and would
perpetrate abuses against the Dongria Kondh adivasi and other
communities on the Hills.
"The Dongria Kondh and other local communities have been struggling
for years for this decision, which is a very welcome one," said
Amnesty International's Asia-Pacific Deputy Director, Madhu Malhotra.
"The companies and the Orissa government should now guarantee that
they will not attempt to simply move the project to another site
without ensuring adequate safeguards - they must ensure they will
respect the human rights of Indigenous and local communities wherever
the companies operate."
Amnesty International also welcomed the government's decision to
suspend the clearance process for the six-fold expansion of the
Lanjigarh refinery at the foothills of Niyamgiri, operated by Vedanta
subsidiary Vedanta Aluminium, after a government's expert committee
found it to be illegal.
"The authorities should order a clean-up of the Lanjigarh refinery,
which has caused air and water pollution, seriously affecting the
rights of neighbouring communities who are finding life there
unbearable", said Madhu Malhotra.
Amnesty International called on government authorities to establish a
clear and transparent process that seeks the free, prior and informed
consent of any Indigenous communities who may be affected by such
projects, and respect their decision, in accordance with national and
international law.
The Ministry-commissioned expert report that underpinned today's
decisions, documented the companies' legal violations and human rights
abuses. Its findings and the rejection of the project are consistent
with Amnesty International's extensive report published in February
2010, Don't Mine us out of Existence: Bauxite Mine and Refinery
Devastate Lives in India.
For eight years, the Dongria Kondh and other communities in Niyamgiri
have been protesting against bauxite mining plans by Vedanta Resources
subsidiary, Sterlite Industries India, and the Orissa Mining
Corporation.
The communities were concerned that the project, which would have been
situated on their traditional sacred lands and habitats, would result
in violations of their rights as Indigenous peoples to water, food,
health, work and other rights to protection of their culture and
identity.
"After years of struggle and visits by committees our voice has
finally reached Delhi," a Dongria Kondh leader today told Amnesty
International.

1984 riots: Delhi Police shielded Sajjan Kumar, says CBI to Supreme Court
The Central Bureau of Investigation (CBI) on Friday told the Supreme Court that the special anti-riots cell of the Delhi Police had conducted 'sham investigations and farce prosecutions' to apparently shield senior Congress leader Sajjan Kumar in connection with his role in a 1984 anti-Sikh riots case in which six persons were killed.
The investigating agency an affidavit urged the apex court to vacate the stay it granted on Kumar's trial in August 13 after the former Member of Parliament challenged his prosecution.
The CBI pleaded that the stay 'seriously prejudiced' the prosecution against the Congress leader.
An apex court Bench comprising Justice P Sathasivam and Justice B S Chauhan while taking on record the affidavit - posted to September 7 the final hearing of the CBI's plea to prosecute Kumar for the Delhi Cantonment riots.
The Delhi High Court had on August 20 rejected a plea to stay the trial of Sajjan Kumar in connection with his role in a 1984 anti-Sikh riots case.
Kumar has two cases registered against him, one of which, a case involving the death of five persons in the Delhi Cantonment area, has been stayed.
The Delhi High Court had on July 19 dismissed Kumar's petition challenging a trial court's order to frame charges against him in the case.n the order, Justice Vipin Sanghi questioned the motive of the Delhi Police in cancelling the First Information Report against Sajjan Kumar when the CBI was still probing the matter.
Justice Sanghi directed the trial court to hold the proceedings against him expeditiously in the anti-Sikh riots cases.
The trial court had on July 7 framed charges against him in another case in connection with the riot case.
The trial court had in May this year framed charges under Sections 302 (murder), 395 (dacoity), 427 (mischief to property), 153A (promoting enmity between different communities) and other provisions of the IPC paving the way for trial of Kumar and five others.
The Supreme Court had on March 29 granted relief to him, saying it would not intervene with a Delhi High Court order that granted bail to Kumar in the case.
The Delhi High Court had on February 26 granted bail to Sajjan Kumar in connection with two cases registered against him in the 1984 anti-Sikh riots case.
The Karkardooma Court had on February 23 issued a fresh non-bailable warrant against Kumar and slammed the Central Bureau of Investigation (CBI) for its failure to arrest Kumar and others accused in the case.
Earlier, the court had issued two non-bailable warrants against Kumar, who had surrendered before the court on March 10. (ANI)

The MPs' conveyance allowance, according to the bill, will now be Rs.4 lakh from Rs.1 lakh earlier.
The bill seeking amendments to the Salaries and Allowances of Members of Parliament Act, 1954, will now have to be cleared by the Rajya Sabha before the hike is implemented. It also enhances pension for former members from Rs.8,000 to Rs.20,000.
The increase will be given with retrospective effect since the beginning of the current Lok Sabha, the 15th, which means MPs will get arrears from May 2009.
The bill was introduced by Parliamentary Affairs Minister Pawan Kumar Bansal.
Some MPs, citing media and public criticism, suggested that there should be a provision of cutting the day's salary when members enforce adjournments.
Bharatiya Janata Party (BJP) leader L.K. Advani said an independent mechanism should have looked into the issue and recommended whatever hike was needed in the salary.
Janata Dal-United (JD-U) seconded Advani's idea and said such a mechanism should be established in future.
Bansal said: 'It is time to set up such a mechanism after a wide ranging discussion with MPs.'
Rashtriya Janata Dal (RJD) leader Lalu Prasad held a contradictory view. He said the constitution had given MPs the right to decide their own salary and 'we are exercising that only'.
Congress' Sanjay Nirupam said he supported the bill 'but the day's salary should be cut when members enforce an adjournment'.
'This will somehow clear our image in public and the media, and will also make us accountable for the work we do,' Nirupam said.
A parliamentary panel headed by Congress member Charandas Mahant had recommended a 500 percent hike in salary from Rs.16,000 to Rs.80,001 - a rupee more than the salary of top bureaucrats.
However, the government rejected the demand of a five-fold increase, inviting severe opposition from a section of MPs led by Lalu Prasad of the RJD and Mulayam Singh Yadav of the Samajwadi Party (SP).
Following the protests, the government decided to hike the non-taxable allowances of parliamentarians, but left their salaries untouched.
The provision for raising salary, daily allowance and minimum and additional pension would involve a recurring annual expenditure of Rs.103.76 crore.
One time expenditure of Rs.118 crore would be incurred on account of arrears of salary and pensions from May last year to July this year
In a major success, joint forces today shot dead Maoist-backed PCPA leader Umakanta Mahato, a prime suspect in the Jnaneswari train mishap case, while bodies of three kidnapped CPI-M supporters were recovered from West Midnapore district. Acting on a tip-off from local people that Mahato, carrying a reward of Rs one lakh on his head announced by CBI, was hiding with a squad at Mohanpur near Lodhasuli jungle, the joint forces comprising CRPF, CoBRA and police personnel surrounded the area at around 1 am, police sources said.
When a cornered Mahto and his squad opened fire, the joint forces led by Additional Joint Superintendent of Police Mukesh Kumar retaliated, with the encounter carrying on till around 5 am, they said. When the firing ceased, the joint forces entered the forested area and found the body of Mahato.
A motorcycle, a mobile phone and a 9 mm pistol were found near the body, they said. Jhargram SP Pravin Tripathy said the operation was a major success as Mahto had been absconding since the announcement of the Rs one lakh reward on his head by the CBI which is investigating the May 28 Jnaneswari Express disaster, which left 148 passengers dead.
Tripathy said the pistol found near Mahto''s body belonged to a police sub-inspector Chinmoy Maiti which was snatched away by Maoists when they attacked him in 2008 near a papermill more in Jhargram town. Maiti was fatally injured in the attack.
He said that 10 people who acted as Maoist informers and gave information about the movement of the joint forces had been arrested earlier so they could not tip off the ultras. PCPA spokesman Asit Mahto, who took over the reins of the Maoist-backed People''s Committee Against Police Atrocities (PCPA), after the arrest on September 26 last year of its Convenor Chhatradhar Mahto, and also carrying a reward of Rs one lakh on his head, was the only other wanted person in the case, still at large.
Senior PCPA leader, Bapi Mahto, who also had the same reward against his head was arrested earlier from a guesthouse near Jamshedpur in Jharkhand on June 20. Meanwhile, the bullet-riddled bodies of three CPI-M supporters, who were abducted last night by Maoists were found from near a pond at Ladabhora area today, police sources said.
The victims were identified as Gopal Mistri, his son Rajiv and nephew Tapan.

Preliminary Report of the All India Fact Finding Team on the Killing
of Azad and H. C Pandey

CDRO put together a team of concerned citizens consisting of Prof.
Emeritus Amit Bahaduri, J.N.U., Delhi, Senior Counsel of Supreme Court
Mr. Prashant Bhushan, Kavita Srivatsava, Human Rights worker from
Rajasthan, Gautam Navlakha writer & from PUDR, Delhi, Kranthi
Chaitanya, Advocate and General Secretary of APCLC, D. Suresh Kumar,
Advocate, APCLC, Ch. Sudhakar Rao, President of OPDR, D.
Venkateswarlu, OPDR. The team visited Wankadi Mandal, Adilabad
District on 20th & 21st of August, 2010 where the alleged encounter of
Mr. Azad @ Cherukuri Rajkumar who was spokesperson of CPI Maoist
Central Committee Member and Journalist Hemachandra Pandey took place
on the intervening night of 1st and 2nd July, 2010. Three fact
findings had earlier already carried out spot investigations. The team
met the local villagers, local police, and local media personal and
perused FIR, inquest and postmortem report.
The FIR No.(Crime ) 40/2010 registered at the Wankadi P.S. of Adilabad
District by the Station House Officer, Mr. Mansoor Ahmed at 9.30 am of
2nd July, 2010 in the English Language gives the following account.
1. The Spl. Intelligence police provided the information that a group
of 20 CPI Maoist had crossed into A.P. from Maharastra and moving
about the forest.
2.The police attached to Asifabad P.S. along with Spl. Party police,
Equipped with "night vision device" went to search for them and found
them between Tarkepalli and Welgi Forest Hillock.
3. On being intercepted the Maoist opened fire and the police also
fired in self defence. The firing lasted for 30 minutes after which
the police climbed the Hill top and halted there for the night. Next
morning during the search they found two unidentified bodies one with
AK -47 Rifle lying next to a 50 years old man and the other 30 years
old "wearing sandals" with 9 mm pistol. This story raises several
questions.
a. How the police were able to pin point the location of the Maoists
in a forest several hundred square kms along with the boarder of A.P.
and Maharashtra.
b. Why did the police plan this location? As the villagers clearly
told us that therein recent years there had been no Maoist activity in
the region.
c. Despite 30 minutes, from 11 pm to 11.30 pm of firing not a single
police personal suffered any injury, whereas only Azad and Hemachandra
Pandey are killed.
d. If there were twenty Maoists as stated in the FIR, howcome, the
police found only 2 kit bags and two weapons? In any escapade there
would be more belongings left behind.
e. If Azad was traveling with a dalam of 20 Maoists then surely he too
would have been in Olive Green dress rather than in civilian dress.
f. If the police were unaware of the identities of the two deceased
upto 9.30am at the time of filing the FIR, then how did the electronic
media learned by 6.00am on 2nd July that Azad had been killed in an
encounter. Several electronic media channels have also announced his
death. So, it clearly shows that the police knew who they had killed.
g. Overwhelming doubt about the police version is raised by the
postmortem report of Azad which shows that the fatal bullet entry
wound from the chest "at the left 2nd intercestal space" had
"darkening burnt edges". The burnt mark at the entry wound are a clear
indication of a bullet being fired from a very close range (no more
than a foot). The corresponding exit wound is at the 9th & 10th inter
vertebral space and depth is 9 inches. That means the bullet entered
from upper chest and traveled downwards. This questions the police
version that Maoist were on the top of the hill and they were below.
It was widely known and reported that the Union Ministry of Home
Affairs, through Swami Agnivesh was engaged in exploring the
possibility of a dialogue with C.P.I. Maoist and the person with whom
Swami Agnivesh was talking with CPI Maoists was Cherukuri Rajkumar @
Azad.
5. The alleged encounter in these circumstances and such a time raises
important questions.
a) How could the Spl. Branch of A.P. Police dedicated to combating
Maoists, murder Azad in this manner without knowledge of the Union
Home Minister as well as the State Government particularly when the
Union Home Ministry is said to be leading the joint offensive against
the Maoists.
b) Why has the Union Home Ministry not interested in seeking an
independent investigation/enquiry into the encounter, despite so many
demands for the same.
c) If the Union Government was sincere in seeking a peace dialogue, it
would have been natural for the Home Minister Mr. Chidambaram to
express concern about the execution of the key actor from the Maoist
side with whom he was exploring the peace dialogue. His explanation on
the floor of the Parliament was that the enquiry is a State subject.
This is unacceptable because the A.P. State Government is run by
Congress Party and had the Union Home Minister sought an enquiry they
could not have refused.
In any case the Central Government is empowered to constitute an
enquiry under the Commission of Enquiries Act,1952.
DEMANDS:
1. In the light of the significance of the assassination, which has
scuttled the peace process, it is imperative that the Government
institute a high level independent enquiry headed by a Sitting/Retired
Judge of the Supreme Court of India, nominated by the Chief Justice of
India.
2. Register an FIR against the police who killed Mr. Azad and Hem
Chandra Pandey and the case be independently investigated in
accordance with the NHRC Guide Lines.

Register strongest protest to China: Indian political parties
Political parties across the spectrum Friday condemned reports of an Indian Army general being unwelcome in China because he has Jammu and Kashmir under his command and appealed to the government to register its protest with Beijing in the strongest possible way.
'The India government and the ministry of external affairs must immediately convey their displeasure in the strongest possible terms to China. This is the worst kind of insult thrust upon India,' said Bharatiya Janata Party (BJP) spokesman Prakash Javadekar.
Lt. Gen. B.S. Jaswal, who heads the sensitive Northern Command that guards the borders with China and Pakistan, was to have visited China for a high-level exchange but Beijing conveyed that he was 'unwelcome' as he had 'difficult' territory under his control.
In retaliation, sources said, India had refused visas to three Chinese army officers to visit India.
Asking the government to take a firm stand on the issue, former external affairs minister Jaswant Singh said: 'You cannot have a situation where a serving and ranking officer of the Indian Army has been denied a legitimate visa for a function which is not a private function. I think the Indian government has to take a very firm and completely unambiguous stand on it.'
'China has no business doing this kind of thing and I have always believed that the Indian government should retaliate in kind...a very strong message should go to China that India will not take such things lying down. China has been discourteous to India and India should not accept this,' said BJP leader Yashwant Sinha, also a former external affairs minister.
The ruling Congress also criticised China's action and said India should register its protest.
'A relationship has to be premised on mutual self-respect. It has to be premised on sensitivity for each other concerns and if at all there is violation of that sensitivity and if there is a reaction from India, I think it is warranted,' said Congress spokesperson Manish Tiwari.
'The ministry is looking into the matter and all talks (with China) are on,' said Minister of State for External Affairs Preenet Kaur.
Chinese envoy Zhang Yan visited South Block Friday afternoon and met officials of the ministry of external affairs for 25 minutes on the Jaswal issue.
The external affairs ministry said Jaswal's visit had not taken place 'due to certain reasons'.
'While we value our exchanges with China, there must be sensitivity to each others' concerns,' said ministry spokesperson Vishnu Prakash.

The Prime Minister, Dr Manmohan Singh, on Friday said India sought a peaceful and tranquil international environment as well as very good relations with all nations, especially with the neighbouring countries and the major powers.
"Foreign policy should also be oriented towards East and South East Asia which were poised for a sustained growth rate in the 21st century. India, by and large had good relations with her neighbours. We were engaging them without looking at reciprocity, in our own enlightened interest," said Dr Singh in his inaugural address to the Heads of Missions (HoMs) at Vigyan Bhawan today.
The Prime Minister observed that foreign policy was basically aimed at pursuing India's national interests.
"Indian diplomats were facilitating the creation of an international environment that was conducive to India's progress, development and attainment of its external goals," said Dr Singh.
Outlining his vision of India, the Prime Minister said that the foremost national goal was to remove poverty and accelerate the pace of economic development. We were building modern infrastructure, which would stand up to the challenge of a fast moving economy.
"The nation was also focusing on human resource development, as it was the quality of human resources that determined the standing of a country in the comity of nations. By the same token, Science and technology was a major factor of power and wealth of a nation. India had to have the ability to master technology," Dr Singh emphasized.
The Prime Minister remarked that India was among the fastest growing economies in the world, which despite the global melt down in 2008-09, had returned to a growth path of 8.5 percent.
"Energy availability was critical to attaining a 9-10 percent growth rate, as one percent growth needed 0.8 percent increase in energy availability. Foreign policy had a very important role in securing India's energy needs," said Dr Singh.
Reflecting on the international environment, Dr Manmohan Singh noted that we were living today in an increasingly inter-dependent world.
"India needed an open trading system and wanted to emerge as a major trading nation in the world. G20 had become a key forum for discussing and shaping international economic and financial policies. Foreign policy had also to pay more attention to functioning of G20," said Dr Singh.
During the three-day conference, the Heads of Missions will call on President Pratibha Devisingh Patil and Vice President Mohammad Hamid Ansari.

India's indegenous 5,000-km range Agni-V nuclear-capable missile that can hit targets in northernmost China is ready for test-firing, Defence Minister A.K. Antony said here Friday but declined to state when this would happen.
The missile was developed following the denial of technology to India. 'The denial has only given us an opportunity to develop a 5,000-km range missile,' Antony said.
The minister was speaking after laying foundation stone for expansion of the Mishra Dhatu Nigam Limited (Midhani) defence public sector company.
He said Indian scientists working in many critical areas have proved that India can overcome sanctions and denials. 'When we face denial, we should take it us a God-sent opportunity and a challenge,' he told the scientists present on the occassion.
Later, in a chat with reporters, Antony declined to give any date for the test-firing of the Agni-V, India's only inter-continental ballistic missile (ICBM).
Allaying apprehensions that the defence sector would lose able hands with the retirement of present generation of scientists, the defence Minister assured that new blood would be injected. 'More new scientists, officers and workers will come into the defence sector,' he said.
Antony promised all support to develop Midhani as a world-class company. He advised the company to go beyond its goal of achieving a turnover of Rs.1,000 crore. 'The sky is the limit. You have a major role to play in meeting the requirements of ISRO, AEC and new areas in defence,' he said.
While talking to reporters, he said there was a need to encourage more private sector participation in defence production.
He said India's policy on defence production was evolving. 'It is a continuous process,' he said.
He pointed out that there was a time when India used to import everything but this had now come down and the country had also permitted 100 percent private sector participation in defence production.
Antony said the country now allowed 26 percent FDI in defence production and also had an offset clause to help Indian industry.
Under the clause, foreign companies that bag an Indian defence contract worth over Rs.300 crore have to plough 30 percent of the value back into the country by way of purchase of local components, services or investments.
Antony also inaugurated an indigenously-built electro-slag refining (ESR) furnace.
He noted that Midhani which started commercial production in 1983 with a modest turnover of Rs.8 crore, had now reached Rs.370 crore.
The expansion, with an investment of Rs.400 crore to Rs.600 crore in three phases is expected to increase the turnover to Rs.1000 crore in five years.
Midhani Chairman and Managing Director Narayana Rao said the company, which was set up for self-reliance in critical defence material, has been supporting programmes in the space, defence, aeronautics and atomic energy sectors.
US economy sees sharp slowdown; grows 1.6 pc in June qtr
The US economy grew at a slower pace than expected at 1.6 per cent in the three months ended June, indicating that recovery is lagging in the world''s largest economy. "Real gross domestic product -- the output of goods and services produced by labour and property located in the US -- increased at an annual rate of 1.6 per cent in the second quarter of 2010," the US Bureau of Economic Analysis (BEA) said in a statement today.
Official data released last month had projected the second-quarter GDP growth at 2.4 per cent. Even though, growth has seen a sharp slowdown, the quarterly expansion rate of 1.6 per cent is higher than expected by analysts.
In the backdrop of sluggish economic data in the last few weeks, analysts were anticipating the national economy to expand just 1.4 per cent in the June quarter. Going by the BEA, the preliminary projection of second quarter GDP growth has been revised higher to 3.7 per cent.
The steep decline in economic growth has been mainly on account of increased imports and fall in private inventory investments. The latest growth figure could increase fears about the overall health of the global economy, which is witnessing a fragile recovery after being rattled by the financial crisis in 2008-09.
"Real exports of goods and services increased 9.1 per cent in the second quarter compared with an increase of 11.4 per cent in the first (quarter). Real imports of goods and services increased 32.4 per cent compared with an increase of 11.2 per cent," the statement noted.
According to the BEA, consumer spending in second quarter rose marginally to two per cent from 1.9 per cent in the first three months of 2010. Despite massive stimulus measures, the American economy -- valued at USD 14.5 trillion -- is recovering at a slow pace and is also grappling with high unemployment levels.
