Respected Madam,

 

We have conducted fact finding on the incident where the victim girl was immorally trafficked as alleged by their family members, in the bordering area of West Bengal. The victim was minor by age at the time of the incident. The incident took place within the jurisdiction of Baduria Police Station, District-North 24 Parganas, West Bengal. The family members of the victim approached to the said police station with specific allegations of forcible abduction and immoral trafficking. After doing nothing, ultimately the police started a case under sections 363/366A/120B of Indian Penal Code without bringing any charge under 'The Immoral Trafficking (Prevention) Act" (ITPA) against the accused persons. The police subsequently rescued the victim girl, but recently the investigating police officer of the case started unnecessary harassment to the victim and her family members in the name of investigation with mala-fide motive. The family members of the victim strongly apprehends that the accused persons managed to influence the investigating police officer of the case in order to direct the outcome of the investigation in their favour. Our attached fact finding report gives details of the incident.

 

Hence, we seek your urgent intervention in this matter in the following manner:- 

  • The whole matter must be probed neutrally by a neutral agency.
  • The alleged impure  role played by the Investigating Police Officer of Baduria Police Station in connection with Baduria Police Station Case no. 180 dated 25.5.2011 must be probed into and until then he must be removed from holding further investigation in the said case.    
  • We also demand that appropriate charge(s) under The Immoral Trafficking (Prevention) Act (ITPA) must be incorporated in the FIR against the accused persons and the police must be directed to probe accordingly.
  • Appropriate rehabilitation, protection and compensation should be provided to the victim.

Particulars of the victim: - Ms. Sakina Khatun(name changed), aged about-14 years, by faith-Muslim, having residence at village- Salua, Police Station-Baduria, District-North 24 Parganas, West Bengal, India.

 

 

Case Details: -

 

The victim minor girl was immorally trafficked on 18.4.2011. The victim's father lodged specific complaint before the local Baduria Police Station. The police did start any specific criminal case but only noted in one GDE no. 1381 dated 25th April 2011. Initially the police did not bother to take any action in this matter. The victim's father took help of a local NGO which helped him to register his complaint as First Information Report at Baduria Police Station being Baduria Police Station Case no. 180 dated 25.5.2011 under sections 363/366A/120B of Indian Penal Code in the matter of the immoral trafficking of his daughter. Subsequently the victim girl was rescued on 18th May 2011 by the police and on 29.5.2011 her statement was recorded before magistrate in Basirhat Court and her medical test was also done. It was also alleged that the minor girl was severally raped while The victim girl is presently residing with her parents and she again joined school.

 

Mr. Mrinal Pal, the Sub-Inspector of Police of Baduria Police Station and also being the Investigation Officer in Baduria Police Station Case no. 180 dated 25.5.2011  called the victim girl's father from his mobile phone and asked him to bring the victim girl at the police station without disclosing any reason, which is grossly illegal to call a woman in the police station in the name of enquiry / investigation as per section 160 of Criminal Procedure Code. The victim's father did not attend the police station with the victim. Subsequently on different times again the aforesaid Investigation Officer called from his mobile phone  (9674172175) and asked for presence of the victim girl at the police station with her original birth certificate otherwise he threatened that he would lessen the impact of the criminal case Baduria Police Station Case no. 180 dated 25.5.2011. Our Fact Finding Team noticed that more than 8 (eight) times the said Investigation Officer, Mr. Mrinal Pal called her father's mobile. The parents of the victim girl one day met with the said investigation officer but he in threatening voice told them that they must produce the victim girl before him otherwise he would pick her up from home.  We also came to know that all the accused persons were arrested and got released after furnishing bail bond in the court.

 

The victim's family members are afraid to produce the victim girl before the aforesaid Investigation Officer Mr. Mrinal Dey as he created a situation of terror with some ill motive upon the minds of the victim girl and her parents. The victim's family strongly apprehends that the said Investigation Officer would coerce her at the police station to lessen the gravity the offences charged against the accused persons in Baduria Police Station Case no. 180 dated 25.5.2011
