ACTION TAKEN BY NHRC IN                                   HUMAN RIGHTS DEFENDER CASES  Case No.677/6/1/2010  The Commission received a complaint from Mary Lawlor, Director, Front Line Protection of Human Rights Defenders, regarding alleged killing of Human Rights Defender, Mr. Amit Jethwa, in Gujarat on 20.07.10. Case No.677/6/1/2010

The Commission received a complaint from Mary Lawlor, Director, Front Line Protection of Human Rights Defenders, regarding alleged killing of Human Rights Defender, Mr. Amit Jethwa, in Gujarat on 20.07.10. She has further stated that Mr. Amit Jethwa was killed because of his human rights activities and particularly because he had leveled allegations regarding illegal mining activities and corruption in the Gir Forests.

The Commission took cognizance of the case on 30.07.10 and issued notice to the Commissioner of Police, Ahmedabad, Gujarat to submit a report in the matter. No report was received within stipulated date. The Commission again considered the matter on 31.01.2011 and directed the Commissioner of Police, to submit the report within eight weeks with these observations. "It is more than five months since the death of Amit Jethwa but the necessary report has not been submitted to the Commission. The Commission believes that the Human Rights Defenders are pro-active partners in the pursuit for realisation of Human Rights. The State Agencies need to play a greater role in ensuring democratic participation of Human Rights Defenders in nation's endeavour to promote and protect Human Rights." Since, required report was not received despite reminders, the Commission vide proceedings dated 21.04.11 has issued summons to the Commissioner of Police, Ahmedabad, Gujarat, to appear before the Commission on 21.06.11.


Case No.226/9/10/2010

The Commission received a complaint from Sh. Pavel Svitil, Charge' D'affaires, Europe Union, Delegation to India drawing its attention towards arrest of Mian Abdul Qayoom, a human rights defender and President of the Jammu & Kashmir, High Court Bar Association, who is currently being held in Hira Nagar Jail.

The Commission took cognizance of the complaint on 20.12.10 and directed to forward a copy of the complaint to the Chief Secretary, Government of Jammu & Kashmir, calling for an action taken report within four weeks. Despite reminders, report has not yet been received.

Case No.634/22/13/2010
Ms.Sakhi Prabhavati, Secretary, World Human Rights Commission & Rescue Centre', New Delhi vide complaint dated 3/4/2010 alleged that being irritated on a complaint made by her to the Commission in the case of violence at Dr.Ambedkar Law College, Chennai the Tamil Nadu police trespassed into her premises in Delhi, took away lap-top, pen-drive, cheque books, keys of the car etc. She was allegedly falsely implicated, took in police custody and tortured physically.

The Commission transmitted the complaint to the Director General of Police, Tamil Nadu to get the allegations made in the complaint looked into and to submit report of action taken within four weeks. Reports dated 23.11.2010 and 29.11.2010, which are similar, have been received from the Additional Director General of Police, Crime Branch, CID, Tamil Nadu.
Upon consideration of the reports and the comments of the complainant on these reports, the Commission vide its proceedings dated 06.04.2011 has observed and directed as under:
Complainant Shri Sarvanan Karuppasamy has sent his comments on the report of the Additional DGP, Crime Branch, CID, Tamil Nadu. He has explained his defence to show that the two cases registered against him and his colleague vide FIR No. 191/09 U/S 420 IPC of police station B-4 Race Course and Crime No. 1/09 U/S 17-/177/417/419/420 and 120-B IPC of OCU, CBCID, Coimbatore City, are false.

Since chargesheets in these two cases have already been filed in the Court, these matters are subjudic and correctness or otherwise of these cases is to be decided only by the Court. This Commission cannot run a parallel inquiry in respect of these cases.

However, from human rights point of view, the following issues arise which need consideration :

(i) Whether Shri Sarvanan Karuppasamy was physically assaulted by the police with iron rods etc. during his police custody remand from 14.05.2009 to 18.05.2009 in FIR No. 1/09 and the complainant sustained injuries?
(ii) Whether the jail authorities refused to admit the complainant Shri Sarvanan Karuppasamy to jail on account of injuries on his body and he was admitted to the CMC hospital vide IP No. 2778 on 18.05.2009?
(iii) Whether the family members of Shri Sarvanan Karuppasamy were informed of his arrest in the two cases?
(iv) Whether Shri Sarvanan Karuppasamy was handcuffed?
(v) Whether the CBCID was not accompanied by women Constables when they arrested Ms. Sakthi Prabhavati from Delhi on 19.11.2009 in FIR No. 1/09?
(vi) Whether the CBCID team did not inform the local police station at Delhi, about the arrest of Ms. Sakthi Prabhavati?
(vii) Whether Ms. Sakthi Prabhavati was kept in their custody by the CBCID for one day before producing her in the Court?

The DGP, Tamil Nadu, is directed to submit a detailed report on the above mentioned queries. He should also forward to the Commission treatment record of Shri Sarvanan Karuppasamy, arrest memo of the accused persons and any other document relevant to the queries. Any document in regional language should be accompanied by its translation in English. The required report is expected in the Commission within four weeks.

Report from DGP, Tamil Nadu is awaited.

Case No.635/22/13/2010
Mr.Saravanan Karuppasamy, Editor-in-Chief, World Human Rights Commission & Rescue Centre', Chennai vide complaint dated 30/6/2010 alleged that the Tamil Nadu Police, in retaliation of his complaint against the police lodged with the Commission, victimized him. It is alleged that he was falsely implicated, arrested and subjected to severe physical torture in custody. The complainant prayed for immediate intervention of the Commission to save him from implication in false cases and under harassment by the police.

The Commission transmitted the complaint to the DGP, Tamil Nadu to get the allegations made in the complaint looked into and to submit an action taken report to the Commission within four weeks. Reports dated 23.11.2010 and 29.11.2010, which are similar, have been received from the Additional Director General of Police, Crime Branch, CID, Tamil Nadu. Upon consideration of the reports and the comments of the complainant on these reports, the Commission vide its proceedings dated 06.04.2011 has observed and directed as under:

The Commission has also forwarded an application dated 13.04.2011 of the complainant seeking protection for visit to his village being forwarded to the DGP, Tamil Nadu, for necessary action on his end.

Case No. 39101/24/1/2010

Shri Bhanwar Pal Singh Jadon, an Advocate, has alleged in his complaint dated 24.05.2010 that police personnel of district Agra conducted raids in villages Udhanpura and Pyampura in the late night of 18.05.2010 and during these raids they assaulted men, women and children and also damaged their house-hold articles and even committed looting. Some women and children even jumped down from the roofs of their houses to save their lives and they suffered serious injuries. The police arrested 16 people who were subjected to severe torture. The complaint is accompanied by clippings of some news papers carrying this report.

The Commission vide proceedings dated 19.10.10 directed to send a copy of the complaint to the Senior Superintendent of Police, Agra to look into the matter and submit an action taken report within four weeks positively. The Commission also directed to club this case with case No. 21245/24/1/2010 as it had already taken cognizance of the said incident in that case on 05.07.10. Another case No. 23055/24/1/2010 was registered in respect of the same incident on a complaint dated 05.06.2010 received from Shri Raj Babbar, Member of Parliament is also linked with this case.

Pursuant to the directions of the Commission, a report has been received from DIG, Agra as per the report, the complaint of Bhanwwar Jadon is being inquired into by the Circle Officer, Bagh. The Commission vide proceedings dated 02.02.11 has directed the DIG, Agra Range, to submit enquiry report within six weeks. Report is still awaited.

Case No. 197/13/34/2011

The complainant, Dr Lenin, Executive Director, People's Vigilance Committee on Human Rights (PVCHR) invited attention of the National Human Rights Commission towards alleged harassment of a Dalit Activist, Sudhir Dhawale by the Maharashtra Police and condemned his arrest under the Unlawful Activities (Prevention) Act.

The Commission took cognizance of the complaint on 10.02.2011 and called for a factual report from the Director General of Police, Maharashtra in 4 weeks. Report is still awaited.

Case No. 4/6/0/2011

The Complainant, Shri Henri Tiphagne, National Coordinator, Human Rights Defenders Alert- India, in his complaint 01.01.2011 informed the National Human Rights Commission about alleged malicious campaign being carried out by certain elements against `The Citizens for Justice and Peace (CJP) and its Secretary, Ms Teesta Setalvad because of their work in cases relating to the Gujarat riots.

The Commission vide its proceedings dated 12.01.2011, called for a factual report from the Chief Secretary, Government of Gujarat in 4 weeks. Report was not received within the stipulated time. Now reminder has been issued on 25.03.11.


Case No. 364/7/4/2011-wc LF 363/7/4/2011-wc

The Commission has received two complaints from Shri Rajeev Kumar Sharma and Shri Amitra Sudan Chakraborthy regarding death of one Sonu, an Human Rights Defender at village Chandrawal, Distt. Fatehabad, Haryana.

The Commission took cognizance of a complaint on 01.03.11 and called for a factual report from the Chief Secretary, Govt. of Haryana within four weeks.
Since report has not been received within the stipulated time, a reminder has been issued.

Case No. 34168/24/4/2010

The complainant, who is a human right activist has alleged that the children at Village Kaanti, Block Jasra, Tahsil Bara, Allahabad are suffering from 4th grade of malnutrition.

On his complaint dated August 10, 2010 the Commission took cognizance on 1.9.2010 and issued notice to Chief Secretary, Government of Uttar Pradesh and District Magistrate Allahabad to submit the report within four weeks.

In response, a letter dated 2.2.2011 received from Special Secretary, Government of Uttar Pradesh, Lucknow with a copy of the report received from District Magistrate, Allahabad. Pesusal of the same reveals that Sanchetna a Local Social Organisation brought to the notice of administration that 12 under nourished children are admitted in the Hospital. Administration issued directions and the children were medically examined. Most of the Children were found affected from seasonal disease and one boy was found suffering from small pox. They were sent to their home on 7.8.2010. On 8.8.2010 the team of medical officers alongwith Distt. Programme Officer and Bal Vikas Project Officer weighed the children and the details are mentioned in the report. It is further revealed that the officers of Sanchetna promised the parents of the Children that they will be got allotted Government Houses and collected the children and got them admitted in Sarojini Naidu Bal Hospital. Due to paucity of beds some of the children were shifted to Government Hospital. Every child was provided proper medical treatment. All the allegations made in the complaint are false and baseless and unfortunate.

While considering the report the Commission found the report to be false and baseless. Copy of the report received from Government of U.P. has been sent to the complainant on 7.3.2011 to obtain his comments in two weeks. Comments are still awaited.

Case No. 120/6/0/2011

The complainant, who is a National Coordinator of an NGO called Human Rights Defenders Alert – India has alleged that after revelations in Media that has exposed the Government sponsored theory that highly placed politicians and officers have been given "Clean Chit", the police officers are served with show cause notice for the fact that they have made available to the Supreme Court initiated SIT the CD of phone calls records that reveal an unholy nexus between the powerful politicians, policeman and the accused.

On his complaint dated 23.2.2011 the Commission took cognizance on 3.3.2011 and directed to transmit the complaint to Chief Secretary and Director General of Police, Gujarat, calling for Action Taken Report within four weeks.

Despite reminders, Action Taken Report is still awaited.

Case No. 961/25/12/2010 LF 967/25/12/2010

The complainant, who is a Secretary of an NGO called MASUM & National Convener of PACTI has alleged that Police have arbitrarily arrested and detained the victim, a Human Right Defender without any reason. It has further alleged that the victim was detailed in a police camp for more than 24 hours.

On his complaint dated 20.10.2010 the Commission took cognizance on 22.10.2010 and directed to transmit the complaint to the Director General of Police, West Bengal calling for Action Taken Report within four weeks.

In the absence of the report from Director General of Police, West Bengal a final reminder was issued on 22.12.2010.

In response a communication dated 28.1.2011 was received from Inspector General of Police, West Bengal vide which he requested to grant two weeks more time for submission of requisite report. As directed by the Commission two weeks of extension of time was granted.

In the meantime a letter dated 2.2.2011 was received from Supdt. of Police, Paschim Medinipur alongwith the report received from SDPO, Jhargram, Paschim Medinipur which revealed that Ajit Mahato was a named accused in case crime No. 280/10. During investigation it transpired that he is also an accused in case No. 281/10. He was arrested and forwarded to court after observing all formalities. Both the cases are under investigation. Copy of memo of arrest has been annexed.

The Commission considered the report on 4.3.2011 and directed to send the report to complainant for his comments, if any within two weeks.

Accordingly, the report has been sent to complainant to obtain his comments, if any, on 9.3.2011. comments are still awaited.

Case No.11939/24/73/2010

The complainant, a human rights defender, in his complaint dated 01.4.2010 has informed that he has lodged a complaint against some police officials, Police Station Gopiganj, with the Commission, in which the Commission has taken cognizance and registered the same as case No. 224/24/73/09-10. The Commission has called for report from the concerned District authorities. The complainant has alleged that the Additional Superintendent of Police, Sant Ravidas Nagar, Uttar Pradesh called him and asked him to withdraw his statement. He has further alleged that when the complainant showed reluctance, the Additional Superintendent of Police, Sant Ravidas Nagar, threatened him that the investigation is being done against him and after lodging FIR, his limbs will be broken. The complainant has apprehended that the Additional Superintendent of Police, Sant Ravidas Nagar, may implicate him in some false cases or kill him in a fake encounter.

The Commission took cognizance of the complaint on 09.04.10. Pursuant to the directions of the Commission, DIG, Vidhyaanchal Range, Mirazapur, sent a report denying the allegations. A copy of the report was sent to the complainant for comments. in his comments, the complainant demanded an enquiry either by a team of Commission or by CBCID as he was not satisfied with the report of the DIG.

The Commission considered the matter on 24.03.11 when it observed and directed as under:
"The Commission has considered the matter on record and notices that the complainant, a human rights activist, appears to be harassed by the police because he is pursuing matters/complaints related to the police. It is also pertinent that he was asked to appear before Ms. Ruchita Choudhary, Addl. Supdt. of Police, Sant Ravi Das Nagar on complaint of Shri Mangla Parsad Chaturvedi, the then SHO, Gopiganj, against whom departmental action has been initiated for releasing one Vinod Kumar Dixit after accepting a bribe of Rs. 5,000/-. This matter was pointed out by the complainant Shri Nand Lal Shukla and the same was registered in this Commission as case No. 224/24/73/09-10, in which a monetary relief of Rs. 25,000/-, in addition to action against the errant policemen, has been recommended. On query Ms. Ruchita Choudhary, ASP Bhadohi, has confirmed that the complainant was called to her office, but there is nothing on the record to establish anything against the complainant. Therefore, it is a matter of concern that a human rights defender is being exploited and harassed by the Addl. Supdt. of Police only because he has exposed police malpractices. As he is still getting threats, it would be appropriate to send a team of the Commission to investigate the matter.

Director General (Investigation) is requested to have the matter investigated by deputing a competent team of the Commission and submit a report within six weeks."

Report is still awaited.

Case No.13773/24/39/2010

Shri Narendra Pratap Singh, Jaunpur, Uttar Pradesh vide complaint dated 5/4/2010 alleged that he is a social worker fighting for the rights of vulnerable persons. He espoused the cause of a lady belonging to Scheduled Caste who had a property dispute with the opponents. At the instance of the opponents, the Circle Officer of the area misbehaved, abused, manhandled and threatened the complainant for taking up the case of the poor lady.
The Commission vide proceedings dated 11.05.10 directed to transmit the complaint to the concerned authority to investigate and report to the Commission. Report received from the concerned authority has been referred to the complainant for comments. Comments are still awaited.

Case No. 42087/24/4/2010

Ms. Manju Pathak, Secretary, Jagriti Mahila Sewa Sansthan, Allahabad in her complaint dated 08.10.2010 alleged that on 28.9.2010 about 06.30 pm she was abused, assaulted and beaten up by Meraj Khan, Constable under Sabji Mandi Police Chowki, Khuldabad, Allahabad, UP when she took up the grievances of a victim lady against him. The Commission vide proceedings dated 27.10.10 directed issuance of a Notice to Supdt. Of Police, Allahabad, calling for a report within four weeks. Despite reminder report is still awaited.

Case No.449/34/8/09-10

The Commission received a complaint dated 25.7.2009 from Shri Munna Kumar @ Deepak Kumar, District President, Manavadhikar Kranti Association, Giridih, R/o Village and PS Hirodih, Post Kisgo, District Giridih, Jharkhand, alleging that on 20.7.2009, SHO of PS Hirodih, Sub-Inspector Sanjay Kumar Burman along with Assistant Sub-Inspector Haro Baitha and other police officials, forcibly entered his house, picked him up, tortured him and illegally confined him in the police lock-up for four hours because he had highlighted the case of violation of human rights of a lady. He requested the Commission to take appropriate action to save his life and property.

The Commission took cognizance in the matter on 6.8.2009 and directed to issue Notice to Superintendent of Police, Giridih, Jharkhand for a report within four weeks. Superintendents of Police, Giridih, Jharkhand vide communication dated 26.8.2009 sent a report which concluded that though the SHO Police Station Hirodih took right action under Section 151 Cr.P.C., but he was found guilty for taking biased action against the complainant and he was asked to explain why disciplinary action should not be taken against him. The Commission considered the report on 1.6.2010 and directed to issue Show Cause Notice under section 18 of the Protection of Human Rights Act 1993 to Chief Secy., Jharkhand for violation of human rights of the complainant and Superintendent of Police, Giridih, Jharkhand was asked to submit the outcome of the disciplinary action initiated against Shri Sanjay Kumar Burman, the then SHO, PS Hirodih. The Deputy Secretary, Govt. of Jharkhand, Home Department vide communication dated 21.09.2010 informed that the State ofJharkhand has no objection to the grant of compensation to the victim Munna Kumar @ Deepak Kumar. Accordingly, the Commission vide proceedings dated 3.11.2010 recommended Chief Secy., Jharkhand to pay Rs. 10,000/- as monetary relief to the victim for violation of his human rights and submit compliance report along with proof of payment to the victim within six weeks. Superintendent of Police, Giridih, Jharkhand vide communication dated 18.07.2010 informed that departmental proceedings No. 32/10 are being initiated against SI, Sanjay Kumar Burman, Thana In-charge, Hirodih and he was again directed to report outcome of the departmental proceedings. Requisite reports are still awaited.

Case No.122/12/2/2011

Ms. Joshodhara Das Gupta & Y.K. Sandhya on behalf of National Alliance for Maternal Health & Human Rights (NAMHHR), New Delhi have alleged that frequent maternal deaths have been occurring in the hospital of Barwani, M.P. They also alleged that the District Admn has harassed many of Jagrit Adivasi Dalit Sangathan(JADS) activists who were on peaceful protest to get the situation corrected. They have prayed for action against the culprits and stopping harassment of the JADS activists.

The Commission has issued notices to DM, SSP, Barwani & CMO, District Hopital, Barwani, calling for a report. Reports are awaited from the authorities.

Case No. 115/18/4/2011

Sh. Bhaktabandhu Behera, a HR Defender working for the GMR Kamalanga Energy Kshytigrasta Praja Sangharsa Samiti, Kamalanga, Dhenkanal, Orissa alleged harassment by GMR personnel & Police Administration. The case has been brought to the notice of Commission by the Human Rights Defenders Alert India – Odisha.
The Commission issued notice to Chief Secretary, Bhubaneshwar, calling for a report. Report has been received and the same is under consideration of the Commission.

Sh. Sudhakar Giri, a HR Defender working for the Uttam Galva Pratirodh Mancha, Keonjhar, Orissa alleged harassment by Uttam Galve Steel Ltd. The case has been brought to the notice of Commission by the Human Rights Defenders Alert India – Odisha.

Sh. Milan Kothari, Convenor, Working Group on Human Rights has drawn attention of the Commission to a case involving the arrest on false charges of five human rights defenders in Tamil Nadu and has prayed for immediate intervention of the Commission. The Commission has also received five other complaints from HRDs regarding this incident. All the matters have been clubbed.

The Commission had directed its DG(I) to depute an officer to collect the facts. DG(I) has submitted his report. As per the report, Madurai Bench of Madras High Court has ordered the case be transferred to CBCID for further investigation.

Case No. 1015/22/13/2010
Mr. Henri Tiphagne, National Co-ordinator, Human Rights Defenders, Madurai, TN in his complaint stated that 3 R.T.I Activist were arrested by Chennai Police on 1.9.10 while demonstrating at gate of Raj Bhawaan, Chennai. They were demonstrating against appointment of Sh. K.S. Sripathy to the post of Chief Information Commissioner without an open and transparent process. The complainant had prayed for release of the 3 R.T.I. Activist, to take measures to ensure their physical and psychological integrity, cancellation of appointment of Mr. Sripathy from the post Chief Information Commissioner & protect the HR Defenders.

Pursuant to the directions of the Commission, report has been received from the Commissioner of Police, Chennai and the same is under consideration by the Commission.

Case No. 32880/24/44/201077 & 32882/24/44/2010

The Commission received two complaints from Mr. Lenin, Executive Director, Peoples Vigilance Committee on Human Rights, Varanasi and Mr. Henri Tiphagne, National Coordinator, Human Rights Defenders, Madurai, TN stating in their complaints that one Hari Lal, the leader of organization called Voice of People (VOP) and a Human Rights Activist who had been vocal on the corruption plaguing the implementation of the Mahatma Gandhi Rural Employment Guarantee Act (MNREGA) was killed by killers hired by the Gram Panchayat leader because of his fight against his corrupt practices. Case Nos. 34271/24/44/2010, 36005/24/44/2010, 36007/24/44/2010, 36017/24/44/2010, 36489/24/44/2010 and 36013/24/44/2010 are also linked with this matter.
The Commission vide proceedings dated 22.03.2011 has directed its DG(I) to conduct an on the spot fact finding enquiry and submit report within 15 days. Thereafter, the matter will be placed before Division Bench of the Commission.



Case No.807/25/15/2010

Sh. Kiriti Roy, Secretary, Bangalore Manavadhikar Suraksha Manch (MASUM) in his complaint dated 10.9.10 stated that on 8.9.10 nine HR Defenders were detained by Naihati Police without assigning any reason and released them after illegal detention of nine hours.

The Commission has issued notice to the DGP, West Bengal calling for a factual report within four weeks. The report is awaited.

The Commission has received a complaint dated 28.03.11 from Ch. Narendra and another complaint dated 28.03.11 from Sh. Henri Tiphagne through email regarding attack on Swami Agnivesh by a mob in Dantewada District, Chhattisgarh. These complaints have been registered as case Nos. 108/33/3/2011 & 109/33/3/2011.

Since the the Commission has already taken suo-motu cognizance of the incident on the basis of a news item published in the Newspaper "The Hindu" dated 27.3.2011 under the caption "Swami Agnivesh, journalists attacked in Dantewada" in case No.106/33/3/2011, these cases have been linked with this case. Report is awaited in the matter.

Case No10558/24/37/2011

The Commission has received a complaint from Sh. Bhoopendra Dayal, a human rights defender, alleging that he was unlawfully detained for five days and tortured by the police at the instance of the opponent. He has further alleged that the opponents has set his shop on fire in collusion with the police and the deprived him of livelihood. He apprehends threats to his life. No action is alleged to have been taken by the police on his complaints.
Taking cognizance of the complaint, the Commission vide proceedings dated 30.03.11 has issued notice to the Superintendent of Police, Mahamayanagar, U.P. calling for a report within four weeks.

Case No.884/7/6/2011

The Commission received a complaint from Rajiv, Human Rights Defender, Hetram Park, Sardhana Cottage, Behind State Bank, Hissar, Haryana alleged that due to his activism in Human Rights matter, local police have been victimizing him to yield to their dictate. The policemen entered in his shop & made murderer attack. The police is pressing for withdrawing complaint made against them. Police may involve him in fake encounter. He apprehends threat to his life.

The Commission took cognizance of the case on 20.04.2011 and issued letter to the Senior Superintendent of Police, Hissar, Haryana calling for a report within four weeks. The requisite report is awaited.

Asian Human Rights Commission, has brought to the notice of the Commission that one Dushman, a human rights defender, working with Badrama Abhayaranya Vikas Parishad, a local human rights organization working for tribal welfare within Badrama Wildlife Santurary, in Sambalpur District of Orissa, was assaulted and injured by a group of persons on 21.03.11 at his house. It has been alleged that no arrests have been made despite registration of FIR and identification of the persons who attacked him.

The Commission vide its proceedings dated 30.3.11 has called for a report from the Superintendent of Police, Sambalpur, Orissa.

Sh. Henri Tiphagne, National Coordinator, Human Rights Defenders Alert- India in his complaint dated 22.03.11 has brought to the notice the threats being issued to Mr. P. Ananda Kumar, a member of the Citizens for Human Rights Movement (CHRM) for having conducted fact finding missions on implementation of the Right to Education Act (RTE) in Chools in the llayankudi region of Sivagangai District.

The Commission vide its proceedings dated 30.3.11 has called for a report from the Superintendent of Police, Sivagangai, Tamil Nadu.

The complainant on behalf of PVCHR (People Vigilance Committee on Human Rights), has brought to the Commission that one human right defender name Rehana, founder of Astitva an NGO and female workers of the organization are being harassed. The matter was reported to the police but police allegedly did not take any action.

The Commission vide its proceedings dated 01.04.11 issued notice to the Senior Superintendent of Police, Muzaffarnagar, Uttar Pradesh, calling for a report within four weeks.

Since the report has not been received within the stipulated time, a reminder has been issued.

Ms. Sabitha from the Secretariat of Human Rights Defenders-Alert informed Shri A. K. Parashar, the HRD Focal Point of the Commission on the helpline that Mr. Babloo Loitongbam, Executive Director of an organization in Manipur and Ms. Ojas S.V., a theatre Artist from Pune were picked up by Kujang P.S. on 16/04/2010 at 6:15 P.M while coming back from Govindpur (proposed POSCO plant area). She prayed for immediate intervention of the Commission. This complaint was registered as Case No. 686/18/23/2011. The telephonic call was followed by an e-mail complaint from Kirty Roy, Secretary Banglar Manav Adhikar Suraksha Manch(MASUM). This complaint was registered as Case No. 685/18/23/2011.

Shri Parashar, Joint Registrar (Law) spoke to Shri. Prasad, Special Secretary, Home, Orissa and apprised him about the contents of the complaint and requested for immediate intervention and to follow rule of law. The complaint received through e-mail was also forwarded to him.

Later in the night, on 16/04/2011 Ms. Sabitha, the Complainant called the HRD Focal Point of the Commission and informed him that Orissa police has released the HRDs. She extended her thanks for immediate intervention of the Commission.

The Commission vide proceedings dated 20.4.2011 has issued notice to DGP, Orissa calling for a detailed report alongwith GD/DD entries, copy of FIR etc, within four weeks.
