01/03/2011 HC allows school students to appear in exam  New Delhi, Feb 28 (PTI) The Delhi High Court today came to the rescue of two school students who were restrained from appearing the annual exams, scheduled for tomorrow, on the ground that they failed to pay their tution fees and directed a private school to allow them to appear in the exams. Justice Rajiv Sahai Endlaw directed Prabhu Dayal Public School to permit Aditya Sharma, and Aditi Sharma, students of class XII, to appear in the annual exams scheduled to be held from March 1, 2011.  The high court also issued notice to the school and the NCT government directing them to file their reply by May 9.  The court''s direction came on a petition filed by the two students through their physically handicapped father.  Their counsel Ashok Aggarwal submitted the school''s action of not allowing the two students to appear in the exam was illegal, arbitrary and violative of right to education guaranteed under the RTE act.  He also argued that the father earns only Rs 3,500 per month and was unable to pay school fees for the year 2010-2011 and his children should be treated under Economically Weaker Section (EWS) category.  The school should grant them freeship under EWS scheme but it was not accepting their request and insisted on their full school fees.
