Delimiting Education – DHC (Chief Justice and Justice Manmohan) today (16.12.2010) issues notices to NDMC, GOI, Delhi Govt, Navyug School and Navyug School Education Society on parents' appeal against the judgment of a single Judge opposing arbitrary admission Policy of NDMC returnable on 07.02.2011. Mr. Ashok Agarwal, advocate appearing for the parents submitted that the right to education is a fundamental right of every child and the NDMC has no authority in law to deny admission to the wards of the petitioners on the ground that they no longer reside in the New Delhi Parliamentary Constituency.

"Admission denied by a public funded school to a neighbourhood child is a violation of Article 14 (right to equality), Article 21 (right to life with dignity), Article 21-A(right to education), and Article 38(right to social justice) of the Constitution of India read with the provisions of Right of Children to Free and Compulsory Education Act, 2009, Delhi Schools Education Act, 1973 and UN Convention on the Rights of the Child (1989)," argued Mr. Agarwal.
